criminal Division - pretrial diversion program

The Pretrial Diversion Program is offered by the Allen County Prosecutor’s Office for certain misdemeanor offenses. This program is offered only through referral by a Deputy Prosecuting Attorney. If referred, by signing up for the Pretrial Diversion Program you have the opportunity to avoid a criminal conviction on your record. Upon completion of the program requirements, the charge you have been arrested for is shown as dismissed.

Only specific offenses are eligible for referral to the Pretrial Diversion Program.

The Pretrial Diversion Program fee is $334.00. A minimum payment can be made of $234.00, with payments of $20.00 for 5 months. Additional amounts can be paid toward the balance at any time until paid in full. You must have the minimum payment of $234.00 (cash, money order or cashier’s check) to sign up for the program.

To sign up, the defendant must appear in person at the Infraction Deferral/Pretrial Diversion window. Both are located at the Criminal Justice Center. Sign up must be completed BEFORE THE NEXT COURT DATE YOU ARE GIVEN AT YOUR INITIAL HEARING.

Requirements differ, based on the offense charged, and may include, but are not limited to, counseling, community service, restitution or proof of a valid driver’s license. The defendant is responsible for any costs associated with these requirements. These costs are not included in the Pretrial Diversion fee.
